Therecentlyconcludedannualsessionofthe14thNationalPeople"sCongresspassedtheStateCouncil"sinstitutionalreformplan,signalingthestartofanewroundofreformwhichwillimproveChina"sdevelopmentpolicyandgovernancesystem.Theplanincludestherestructuringofcertaindepartments,adjustingtheirfunctionsandresponsibilities,andcreatingnewStateCouncilagencies.

Theplanalsoincludestheestablishmentofa"nationalfinancialsupervisionadministration"anda"nationaldatabureau",andtherestructuringoftheMinistryofScienceandTechnology.InChina"spushforinnovation-drivendevelopmentandbetterprotectingintellectualpropertyrights(IPR),theimprovementoftheintellectualpropertymanagementsystemisanimportantpartintheStateCouncil"sinstitutionalreform.

Asacrucialcomponentofthecountry"sopening-uppolicy,thenewroundofreformiscriticaltostrengtheningtheruleoflaw,enhancingadministrativeefficiency,andadvancingnationalandsocialdevelopment.OfparticularimportanceistheplantoimprovethemanagementofIPR,whichinvolvesadjustingandcoordinatingthefunctionsoftheNationalIntellectualPropertyAdministrationandtheStateAdministrationforMarketRegulation.ThisisanotherimportantreforminChina"sadministrativemanagementsystemtobetterprotectIPR.

ThepurposeofthisroundofreformisalsotoexpeditiouslybuildChinaintoanintellectualpropertypowerhouse,andboostthecreation,use,protection,managementandservicesofintellectualproperty.

InSeptember2021,theCommunistPartyofChinaCentralCommitteeandtheStateCouncil,China"sCabinet,issuedtheoutlineofbuildingChinaintoastrongintellectualpropertycountry(2021-35).Hence,thereformoftheadministrativemanagementsystemforIPRreflectsnotonlytheimportanceofbuildingChinaintoanintellectualpropertypowerhousebutalsoChina"sdeterminationtostrengthenIPRprotectionandpromoteitsutilization.

Withtheimplementationofthenewreformplan,ChinawillbettermanageandprotectIPRatthenationallevelthroughthecoordinatedeffortsoftheStateAdministrationforMarketRegulationandtheNationalIntellectualPropertyAdministration.Theformerwillhandletheadministrativelawenforcementworkrelatedtopatentsandtrademarks,whilethelatterwillprovideprofessionalguidanceforthework.Also,theNationalIntellectualPropertyAdministrationwillberesponsibleforpatentandtrademarkauthorization,foreignintellectualpropertyaffairs,andpublicmanagementofintellectualproperty.

IPRisanexclusiverightenjoyedbyintellectualpropertyownerswholegallyowntheircreationsforuseincommerceandindustry.Today,intellectualpropertyhasbecomeastrategicresourcefornationaldevelopmentandacoreelementofglobalcompetitiveness.Itisamajorissueatthenationalstrategiclevel.Andtheintellectualpropertysystemishighlyglobalized,withindustrializedWesterncountrieshavingdevelopedandimplementedtheintellectualpropertysystemfromanationalstrategicperspective.

OnJun5,2008,theStateCouncilissuedtheNationalIntellectualPropertyStrategyOutline,whichhashelpedChinamakeremarkableachievementsinimprovingtheintellectualpropertysystem,strengtheningIPRprotection,andpromotingtheeffectiveuseofintellectualproperty.

Inthecontextofthedevelopmentofthedigitaleconomyandemergingtechnologies,thestatusandroleofintellectualpropertyintheeconomicandsocialsphereshavebecomeincreasinglyprominent.Recognizingthis,ChinahaslaunchedtheIntellectualPropertyStrongCountryConstructionproject.

TheOutlineoftheConstructionofIntellectualPropertyStrongCountry(2021-35)proposestobuildamodernsocialistintellectualpropertysystem,createaworld-classbusinessenvironmentwithamechanismforprotectingintellectualproperty,andestablishefficientsystemsforincentivizinginnovationthroughintellectualpropertymarketsandfacilitatingpublicintellectualpropertyservices,promoteahumanisticsocialenvironmentforthehigh-qualitydevelopmentofintellectualproperty,andparticipateinglobalintellectualpropertygovernance.

Thesestrategicmeasuresandpoliciesalsoincludeimprovingthemanagementsystemofintellectualpropertyandstrengtheningcollaborativeprotection.Forexample,itproposesto"constructamanagementsystemwithunifiedresponsibilities,scientificnorms,andexcellentservices","establishaconvenient,efficient,strict,fair,open,andtransparentadministrativeprotectionsystem",anddevelop"acollaborativeprotectionpatternwithunifiedleadership,smoothconnections,andfastandefficientcoordination".

Infact,therecentreforminIPRprotectionandadministrativemanagementhasenabledtheStateAdministrationforMarketRegulationandtheNationalIntellectualPropertyAdministrationtobetterfulfilltheirfunctionsinIPRprotectionandmanagement,andstrengthenChina"sstrategyforapplyingintellectualpropertyincommerceandindustry,inordertotransformChinaintoaninnovation-drivencountryandanintellectualpropertypowerhouse.
